After years of discussions inside and outside Brazilian IP circles, a political step has finally pushed the country towards the “no longer” inevitable position of acceding to the Madrid Protocol. c
The next step in the process consists of further analysis of the subject at the Senate and, if the same positive outcome should happen, the Madrid Protocol is likely to be ratified by President Bolsonaro and become effective possibly no later than 2019.
Herrero has a very extensive knowledge of the system after Spain has been a part of it for so many years. Our teams, in Spain and Mexico are already fully equipped and experienced on the subject and ready to take on this challenge also in Rio de Janeiro.
The Madrid Protocol is the tool to facilitate registration of trademarks in different countries by means of a centralized system administered by WIPO and will soon be available to Brazilians.
The Head of Herrero Brazil, Maria Pia Guerra, has worked for 4 years at the World Intellectual Property Organization (WIPO) as a Legal Consultant at the International Registration Department for the Madrid and Hague Systems, and has dealt with various legal and administrative matters related exclusively to the protection of trademarks in all countries members of the Madrid System. Her background will allow Herrero to properly assist its Brazilian and international clients, by conducting them through the proper use of the international registration route, applying all of its rules and regulations from a very experienced point of view.
