On 23 August 2023, Resolution 262/2023, dated 17 August 2023, was published in the Official Gazette, by which the National Institute of Industrial Property (INPI) formalised the attachment to the Digital Access Service for Priority Documents (DAS-Document Administration System) for trademark and industrial design applications.
Thus, as of 1 September 2023, the Argentinean Trademark and Industrial Designs Offices can access foreign trademark and design applications filed in those countries that adopt the DAS system to carry out the verifications of each case; thus joining the Argentinean Patent Office, which had already recently incorporated the DAS System.
The authorities of the Trademark Office and the authorities of the Industrial Designs Office are working and analysing whether or not it is necessary to issue a regulation for the application of the DAS System in their respective areas, in accordance with the provisions of art. 3 of the aforementioned Resolution.
Finally, we remind you that it is still required to file a Spanish translation of the priority application, which must be done by a certified translator registered in Argentina.
As soon as the Trademark Office and the Design Office formally express their views on the regulation to implement the use of DAS, we will come back to this issue. In the meantime, we remain at your disposal for any further clarification you may require.
