Fostering sustainable innovation: INDECOPI’s Accelerated Green Patents Program in Peru

The National Institute for the Defense of Competition and the Protection of Intellectual Property of Peru has launched the 'Accelerated Green Patents Program', aimed at promoting economic, scientific and technological development through sustainable technologies.

In an increasingly environmentally conscious world, sustainable innovation has become imperative. In line with this, the National Institute for the Defense of Competition and the Protection of Intellectual Property (INDECOPI) of Peru has launched the “Accelerated Green Patents Program”, an initiative aimed at promoting economic, scientific and technological development by fostering ecologically sustainable technologies. This initiative, outlined in Resolution No. 001160-2024/DIN-INDECOPI of April 19, 2024, marks a significant milestone in the push towards a greener and more sustainable economy.

The main objective of this program is clear: to catalyze the adoption and creation of technologies that minimize environmental impact and promote more responsible business practices. However, how does this program work and who can benefit from it?

To participate in the Accelerated Green Patents Program, several key requirements must be met:

Classification in the IPC Green Inventory

Patent applications wishing to benefit from the program must be classified in the specified groups in the International Patent Classification (IPC) Green Inventory. This inventory, available in the WIPO’s IPC GREEN INVENTORY, serves as a reference for identifying technologies that contribute to environmental.

Publication and corresponding payment

Patent applications must have been published and the deadline for filing oppositions must have expired, along with the corresponding payment for substantive examination. This requirement ensures that proposed technologies have undergone an initial evaluation process before being considered for the program.

Absence of patentability examination notification

The Directorate of Inventions and New Technologies must not have notified a patentability examination of the patent application. This indicates that the application has not yet been evaluated in terms of its technical and legal feasibility.

Absence of additional fees

No additional fees will be applied to participate in the program, eliminating financial barriers for innovators wishing to contribute to the sustainability cause.

It is important to note that the Accelerated Green Patents Program came into effect on May 2, 2024, and will apply to patent applications for inventions and utility models filed from January 2, 2023, including national phase PCT applications and divisional applications. This retroactive measure demonstrates INDECOPI’s commitment to promoting sustainable innovation and providing equitable opportunities for those wishing to contribute to this goal.

In conclusion, INDECOPI’s Accelerated Green Patents Program represents a significant step towards creating a more sustainable innovation ecosystem in Peru. By facilitating access to incentives and resources for innovators developing environmentally friendly technologies, the groundwork is laid for more balanced economic growth and a society more aware of its impact on the planet. This program not only drives innovation but also promotes a paradigm shift towards more responsible and sustainable business practices.
