Presidential decree institutes the National Intellectual Property Strategy (ENPI)

Creating a more competitive economy with a higher employment rate depends on a variety of factors, but an effective system for the protection and promotion of intellectual property is undoubtedly among the most important.

On December 7, 2021, President Jair Bolsonaro issued Decree n. 10,886, which institutes the National Intellectual Property Strategy (ENPI) for the period 2021 to 2023. The objective is to guide priority initiatives on the subject in the federal government for the next 10 years.

The National Intellectual Property Strategy (ENPI) was launched in December 2020, by the Ministry of Economy with the purpose of establishing an effective National Intellectual Property System, which encourages creativity and investments in innovation to promote competitiveness and Brazilian socioeconomic development.

Through structuring, integrated and pragmatic actions, ENPI proposes to create an environment, conditions and tools, that can in conjunction with the stakeholders of the National System of Intellectual Property (SNPI) and the National System of Science, Technology and Innovation (SNCTI), contribute to the advancement of Brazil towards new levels of investment attractiveness, competitiveness and job creation. Creating a more competitive economy with a higher employment rate depends on a variety of factors, but an effective system for the protection and promotion of intellectual property is undoubtedly among the most important, given the ability of IP to encourage creativity and innovation across the economy.

After diagnosing the main problems and challenges of Intellectual Property in the country, the ENPI was built based on 7 lines of action:

1- IP for Competitiveness and Development;
2- Dissemination, Training and Training in IP;
3- Governance and Institutional Strengthening;
4- Modernization of Legal Frameworks;
5- Compliance and Legal Security;
6- Intelligence and Future Vision; and
7- Insertion of Brazil in the Global IP System.

Goals:

According to the executive secretary of the responsible group, the main goals of ENPI are: to make Brazil among the 10 countries in the world where most requests for protection of intellectual property are filed; that industries intensive in Intellectual Property contribute directly with 30% of the added value to the national GDP; and that 80% of innovative national companies use tools to protect their Intellectual Property.

ENPI will be implemented through biennial action plans, with priority actions, deliveries, deadlines and targets.
