Recent Developments in Latin American IP Legislations: Updates in Mexico and Argentina

In the last few days , there has been some developments in Latinamerican IP legilations and procedures.


The Mexican Institute of Industrial Property has already implemented and is providing the service to process and manage all new national designation procedures from the Hague via the online patent system (electronic management) using the PASE account.

For this reason, there are some procedures that would be beneficial for you:

  1. Continuation of the procedure through electronic: After WIPO publishes the international registration (DM) in its electronic Gazette, the procedure can be continued electronically through the Online Patent system at IMPI.
  2. Ease of document submission: If any priority is claimed in the international registration (DM), a certified copy of the priority document (and its translation if applicable) must be submitted along with the payment of the relevant fee. Therefore, the document can be uploaded in PDF format through the DAS code.
  3. Response to refusals: Responses to refusals can be filed via the Online Patent system.”


In addition to this modification in the mexican procedure, Argentina has some important modifications for the last days of 2023.

We wish to apprise you of the recent adjustments made to the official fee structure at the Argentinian Patent and Trademark Office, slated to take effect from the 1st of December, 2023.

In essence, the revised fees exhibit an increase ranging from 200% to 400% in comparison to the existing tariffs. In light of this, for both pending new filings and the ongoing continuation/renewal of processes, we recommend submitting your instructions well before the mentioned date, ensuring ample time for processing and mitigating the impact of the upcoming changes.
