Important changes review regarding the regulation of consumer law.

2022 has been a year of profound changes in the Spanish regulation of consumer law and, in particular, of online commerce and from H&A we want to contact you to inform you of how it affects your business model.

Numerous amendments to the Spanish General Law for the Defense of Consumers and Users (LGDCU) have been approved and new specific laws are being passed almost continuously. These include new regulations on digital goods, content or services; multiple changes in the content and manner of presenting pre-contractual information, commercial offers and even labeling; or the expansion of consumer rights, such as the right of withdrawal – which implies new information obligations for companies regarding distance contracts – or the increase in the legal guarantee, which is now 3 years.

These modifications have a direct impact on the way in which the terms and conditions of the websites must be written and provided, as well as the payment, shipping, return and warranty conditions. As they are mandatory, they are enforceable by consumer associations and public administrations, which may impose penalties for their infringement.
