The Trademarks, Industrial Designs and Geographical Indication board (DIRMA) announced on 21.09.2021 that, from October 01, 2021, the registration of trademarks in the form of position marks will become a viable option in Brazil.
The truth is that it is a reality that the protection of trademarks previously known as non-traditional is growing and many countries, including the United States, already allow the registration of these trademarks. Now, Brazil also joins this list.
What is a position mark and how can it be registered in Brazil?
If we recapitulate the information, we must say that is considered a position mark the application of a distinctive sign in a singular and specific position of a given support, dissociated from technical or functional effect.
Therefore, a representation that allows identifying the exact position of the mark in relation to specific products will be necessary, that is, a graphic element that highlights a specific position within a product and that this is considered distinctive, in a way that allows it to link a specific product or service to a specific commercial source.
In this type of distinctive signs, a brief description is also allowed in the application, about the specific position of the mark to be registered.
It will be allowed to change the form of presentation of trademark applications filed before the entry into force of this new option that are pending examination by the BPTO. The change must be requested by the interested party within 90 (ninety) days from October 01, 2021.
In addition to the above, it should be noted that the examination of a request related to a position mark will only be carried out after the necessary adaptations for processing this request in the BPTO’ system.
